1. Acceptance of terms

By accessing our website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our site or place an order.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to place an order. By ordering, you represent that you meet these requirements.

3. The products

Each Toast & Frame keepsake is designed and handcrafted in California from clear acrylic and is made to order. Because our pieces are handmade and displayed on screens that vary, colors, finish, and minor details may differ slightly from what you see online, and slight variation between individual pieces is normal and not a defect.

4. Custom order process & your responsibilities

You are responsible for the content you submit. Before submitting your order, you must confirm the accuracy of your photo and all personalization, including spelling, names, dates, and message text. We produce your keepsake based on what you approve, so please review it carefully. We reserve the right to refuse or cancel any order containing images or content that is offensive, unlawful, infringing on others' rights, or of insufficient resolution or quality to produce a satisfactory result.

5. Intellectual property & image license

You represent and warrant that you own, or have all necessary rights, licenses, and permissions to use, the photos and content you upload, and that our use of them to fulfill your order will not violate any third party's rights.

You grant Toast & Frame a limited, non-exclusive license to reproduce, modify (for sizing and layout), and print your uploaded images and text solely for the purpose of producing and fulfilling your order.

You agree to indemnify and hold Toast & Frame harmless from any third-party claims arising out of the content you submit, including claims of copyright, trademark, privacy, or publicity rights infringement.

All other content on our site — including our brand name, logo, text, designs, graphics, and the Toast & Frame look and feel — is the property of Toast&Frame, LLC and is protected by intellectual property laws. You may not use it without our written permission.

6. Pricing & payment

All prices are listed in U.S. dollars and are subject to applicable California sales tax. Payments are processed securely through Stripe, and your card is charged at the time you place your order. We reserve the right to correct pricing errors and to change prices at any time before you order.

7. Order acceptance & cancellation

Your order is an offer to purchase, which we may accept or decline. You may cancel your order for a full refund any time before production begins. Once production has started, your custom order is final and cannot be cancelled. See our Returns & Refunds policy for details.

8. Shipping

Shipping timelines, costs, and carriers are described in our Shipping Policy, which is incorporated into these Terms.

9. Returns

Because our products are custom-made, all sales are final and custom items are not returnable for change of mind. If your order is damaged, defective, or not what you approved, we'll make it right — see our Returns & Refunds policy.

10. Disclaimer of warranties

Our website and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Toast&Frame, LLC's total liability for any claim arising out of or relating to your order or these Terms shall not exceed the amount you actually paid for the order at issue. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any rights you may have as a consumer under California law that cannot be waived.

12. Indemnification

You agree to indemnify, defend, and hold harmless Toast&Frame, LLC and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of our site or products, including any content you submit.

13. Governing law & venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction.

14. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the “Last updated” date above. Your continued use of our site or placing of an order after changes take effect means you accept the updated Terms.
